Terms and Conditions

Tickets sold to Musica Viva performances are subject to the following conditions of sale and to the requirements of the performance venues. By forwarding a subscription application, it is understood that you have read and accepted these Terms and Conditions. If you acquire tickets on behalf of someone else, you will be deemed to have agreed to these terms on your own behalf as an agent for them.

Subscriptions

  • Musica Viva will issue you with your own personal subscriber number. Please record this number to quote in any further correspondence or contact with Musica Viva regarding your subscription.
  • Subscription tickets may be exchanged after Monday 18 January 2010. Exchanges are subject to availability. An upgrade fee may apply where lower face-value tickets are exchanged for higher-face-value tickets. If exchanging higher-face-value tickets for lower-face-value tickets the difference will not be refunded. Tickets must be returned to Musica Viva seven days prior to the concert in question, to process the exchange.
  • Musica Viva will use its best endeavors to meet your subscription ticket request. The allocation of tickets however, is subject to availability.
  • Under 30 subscriptions are available to persons aged under 30 at the time of booking. Proof of age must be supplied when booking and may be required prior to admission to each concert.
  • Under 30 subscribers are allocated best available seating at the time of booking.
  • Student subscriptions are available to full-time students. Proof in the form of a copy of a full-time student card must be supplied when booking and may be required prior to admission to each concert.

General Conditions

  • The right of admission is reserved.
  • Booking fees may be applicable.
  • No refunds or exchanges except as provided in the Live Performance Australia Code of Practice for the Ticketing of Live Entertainment in Australia
  • All ticket sales are final. No refunds or cancellations will be accepted once a subscription order has been processed.
  • Tickets are valid only if they are purchased through Musica Viva’s Patron Services or a Musica Viva authorised ticketing agent.
  • Patrons arriving late to a performance will not be admitted into the auditorium until there is a suitable break in the performance.
  • Musica Viva reserves the right to alter, substitute or withdraw any advertised programs, artists, venues and to change any seating arrangements.
  • Cameras and other recording devices are prohibited in the venue’s auditorium. Mobile telephones, pagers and similar equipment must be switched off before entry into the venue’s auditorium.
  • In general performances are unsuitable for children under the age of seven.
  • Ticket holders enter the venue at their own risk.
  • Musica Viva is not liable to subscribers for any claims, damages, compensation, losses or expenses as a result of a performance being cancelled, postponed or changed.
  • All patrons, regardless of age, must hold a valid ticket and occupy a seat or predetermined position (unless this has the potential to cause injury to a person).
  • Patrons who disrupt a performance, who are in possession of a prohibited item, or who are unable to produce valid concession identification when requested to do so, may be removed from the venue without refund of a ticket purchase.
  • Musica Viva reserves the right to record, broadcast and simulcast any performance.
  • All patrons are responsible for their own safety and property, and for the safety and property of any person accompanying them.
  • If you are photographed, filmed or taped whilst attending a Musica Viva concert, you consent to Musica Viva or third parties appointed by Musica Viva photographing, filming and taping you. Musica Viva or third parties appointed by Musica Viva can broadcast, publish, license and use any photographs, film, recordings and images of you without compensation. Musica Viva, the third parties and anyone acquiring from them a right to use the material are not liable
  • in any way for its use.

Conditions of Entry for 2010 Subscription Competition

1) Information on how to enter and prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

2) Entry is open to residents of Australia, aged 18 and over, who purchase a subscription to Musica Viva’s 2010 International Concert Season by Sunday 20 December 2009. Employees and their immediate families of Musica Viva Australia ‘The Promoter’ (ABN: 94 504 497 655) are not eligible to enter this promotion.

3) The Promotion commences at 9.00 am AEST on Monday 24 August 2009 and closes at 5.00pm AEST on Sunday 20 December 2009 ('promotion period').

4) To enter, participants must purchase a subscription to Musica Viva’s 2010 International Concert Season either by calling Musica Viva’s Patron Services on 1800 688 482 Mon-Fri (9am-5pm AEST), mailing a completed 2010 International Concert Season Subscription Booking Form to Musica Viva PO Box 1687, Strawberry Hills NSW 2012, or completing an online booking at musicaviva.com.au. The person named as the subscriber will be the participant in the promotion and the recipient of any prize, irrespective of who paid for the subscription.

5) All valid subscriptions to Music Viva’s 2010 International Concert Season received by 11.59pm AEST Sunday 20 December 2009 will automatically be entered into the draw. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry.

6) There will be one Grand Prize draw. The draw will take place at 1.00pm AEST on Wednesday 23 December 2009 at Musica Viva Australia’s National Office, Level 2, 120 Chalmers Street, Surry Hills NSW 2010.

7) The Grand Prize is a trip for two people to the 2010 Edinburgh International Festival. The prize includes the following:

  • Return economy flights for two people from the winner's nearest Australian capital city to Edinburgh, Scotland (including all taxes).
  • A double pass to five events (selected by Musica Viva) at the 2010 Edinburgh International Festival.

8) The Grand Prize is valued at $6,672 (the prize value is correct at time of printing).Travel must be taken during the Edinburgh 2010 International Festival period between Friday 13 August and Sunday 5 September 2010 and is subject to availability. Prize winners are recommended to confirm flight dates as early as possible to ensure availability. Flights cannot be refunded for cash or transferred and cannot be used in conjunction with Frequent Flyer programs. The Grand Prize does not cover any other travel costs incurred. All components of the prize must be taken together. Airline tickets must be used in conjunction with the trip over the specified routing in the stated class of travel. Travel restrictions may apply. The prize winner and their travel companion must travel together. Accommodation, meals and tips, transfer fees, domestic travel to and from departure point, passports, and any other personal expenses and travel insurances must be paid for by the winner. If for any reason the winner is unable to accept the prize as stated, and between the dates indicated, the winner will forfeit the prize and no compensation will be given in lieu.

9) The winner will be notified by phone and in writing.

10) The winner must confirm his/her ability to accept the prize by 5.00pm AEST on Wednesday 20 January 2010.

11) The Promoter will publish the winner’s name on musicaviva.com.au on Monday 11 January 2010 and in Musica Viva’s online eNewsletter in January 2010.

12) The Promoter will publish the winner’s name in The Melbourne Age on Monday 11 January 2010.

13) The Promoter reserves the right to redraw in the event of any entrant not claiming a prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a redraw, at the same place as the original draw at 1.00pm on Monday 25 January 2010.

14) Promoter's decision is final and no correspondence will be entered into.

15) The winner agrees to the use of his/her name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

16) If for any reason this promotion is not capable of running as planned (whether caused by flight delay or cancellation, Edinburgh Festival delay or cancellation or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion), the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

17) By entering the promotion, each entrant agrees in addition to the above uses, that the Promoter may disclose entrants' personal information, to State and Territory lottery departments, the winners' names will be published as required under the relevant lottery legislation and the Promoter may publish or cause to be published the winner's names and suburb in any media.

Coffee Concerts

Prices and Discount Offers
No booking or handling fee is charged by Musica Viva Patron Services for processing subscriptions or additional tickets purchased by subscribers.

Musica Viva tickets are not subject to GST.

All ticket sales are final. No refunds or cancellations will be accepted once your order has been processed.

Part-Payment Options
If paying by credit card, you may opt to pay in two easy installments, the first at the time of booking and the second after 12 January 2009.

Subscribers using the part-payment option will be sent all tickets after the first installment has been paid.

Subscriber Ticket Exchanges
Musica Viva’s ticket exchange options allow you to change your ticket(s) to another subscription concert of your choice. Alternatively, you can transfer tickets to family members or friends at no extra cost, or donate your tickets back to Musica Viva and we will issue you a tax deductible receipt for the price of the tickets. If you donate your tickets we must receive the tickets at least 72 hours prior to the concert. Please enclose a stamped self-addressed envelope with your ticket exchange request.

Ticket exchanges are subject to the following conditions:
Ticket exchanges within the Coffee Concert Series are free. An upgrade fee applies to tickets exchanges to National Concert Series events;

Ticket exchanges are available to subscribers only, up to seven days in advance of the concert for which you hold tickets, or the concert to which you are transferring, whichever is the earlier date;

Exchanges are only available after single tickets sales open Monday 19 January 2009.

Additional tickets
Additional tickets ordered with your subscription will be forwarded to you at least two weeks prior to the performance date.

Subscription seating allocation

Subscribers receive the same seating for each concert, renewable from year to year.

Primary and Accompanying Subscribers whose details are provided on the same booking form will automatically be seated next to year other (subject to availability)

Send the forms of anyone else with whom you wish to be seated.

Subscribers wishing to sit together must send their forms in together.

We will allocate the best seating available when:
We are unable to exactly match the seat numbers you have indicated

We are unable to provide the same seat for each concert, or

We cannot provide seating next to your subscription seats for additional tickets.

Membership and voting rights
All subscribers automatically become members of their state branch of Musica Viva Australia with voting rights, a VivaCard and eligibility for subscriber benefits.

How will you ensure my privacy is respected?
Your personal details will be treated with confidentiality, in accordance with the appropriate legislation and Musica Viva’s Privacy Policy.
 

2009 National Concert Series

Prices and Discounts
No booking or handling fee is charged by Musica Viva’s Box Office for subscriptions or additional tickets purchased by subscribers.

Musica Viva’s tickets are not subject to GST.

All ticket sales are final. No refunds or cancellations will be accepted once your order has been processed.

Subscriber Ticket Exchanges
Musica Viva’s ticket exchange options allow subscribers to change ticket(s) to another subscription concert. Alternatively, subscribers can transfer tickets to family members or donate the tickets back to Musica Viva for a tax deductible receipt.

To process a ticket exchange Musica Viva must receive the original tickets at least 72 hours prior to the relevant concert.

The first two tickets exchanges are gratis. An upgrade fee may apply for any subsequent exchanges, if lower priced tickets are being exchanged for higher priced tickets.

Subscription Seating Allocation
Gold and City Subscriptions (full, concession and Under 30) receive the same seating for each concert, renewable from year to year.

DIY and Student Subscriptions comprise best available seating that may vary between concerts.

Primary and Accompanying Subscribers whose details are provided on the same booking form will automatically be seated next to each other (subject to seating availability)

Subscribers wishing to sit together must send their forms in together.

Musica Viva will allocate the best available seating when:

  • Unable to exactly match the seat numbers you have indicated
  • Unable to provide the same seat for each concert, or
  • Unable to provide seating next to your subscription seats for additional tickets.

Subscription Processing
Gold subscription orders are processed before DIY subscriptions. Within these categories, renewing subscriptions (including seating upgrades and changeovers to another Series) are processed before new subscriptions.

Thereafter, orders are processed as received and the best available seats are issued.

Additional tickets are processed after Gold and DIY subscriptions.

New subscriptions close two weeks prior to the first concert in each centre.

DIY Flexi subscription tickets must be booked no later than 48 hours prior to a concert. Redeem vouchers by mail and tickets will be posted to you before the concert, or if booking 48 hours in advance telephone 1800 688 482 to reserve your seats and collect tickets on the night. Vouchers expire 31 December 2007.

Membership and Voting Rights

All Gold subscribers in Sydney automatically become members of Musica Viva.

Membership includes voting rights.

Musica Viva Australia is a company limited by guarantee. As a member of Musica Viva, the maximum you may be eligible to contribute in the unlikely event of the company being wound up would be one dollar.
